Our General Terms and Conditions, hereinafter referred to as GTC, aim to regulate the business relationship between you and us (GOLDEN SECTION ART) in a binding and fair manner. By placing an order with us you accept these conditions.
For the business relationship between GOLDEN SECTION ART and the buyer the GTC in the version valid at the time of the order apply.
The following advice is also included in our Terms and Conditions:
- We only use high-quality materials to produce our unique pieces, editions and art prints. Nevertheless, source materials are subject to change due to any environmental factors they are exposed to. The papers, dyes, chemicals and other materials used in the production of the artworks may change slightly over time.
- For the aforementioned reasons, edition prints may differ slightly.
- Changes can also occur over time due to: high temperatures, high humidity, or exposure to high levels of sunlight. Significant fluctuations in any of these conditions may also affect the products.
- To ensure that you can enjoy our works of art for a long time, you should not expose them to direct or hang them directly above heaters. You should not expose them to humidity levels that exceed those of normal living spaces. The works of art offered at GOLDEN SECTION ART are not suitable for outdoor-, basement-, bathroom- or kitchen spaces.
- Works of art require careful handling and transportation and should, therefore, always be handled using gloves or comparable protection.
1. Scope of application
1.1 These GTC apply to all contracts concluded between GOLDEN SECTION ART, represented by the owner Ms Maria Kossak (hereinafter referred to as ‘Seller’), and customers via this webshop or through a direct order.
1.2 Customers within the meaning of these GTC are consumers who enter into a legal transaction with GOLDEN SECTION ART.
2. Offers and Conclusion of Contract
2.1 The presentation of the products in the webshop does not constitute a binding offer, but a non-binding invitation to place an order.
2.2 The artworks displayed in our shop have been intentionally embedded into photorealistic illustrations to provide an impression of how they could look in situ. The depicted frames, proportions, and surrounding elements are for visualisation purposes only.
2.3 In each product description, you will find photos of the actual physical artworks, as well as detailed shots, such as signatures. The scope of delivery is listed under "Dimensions and Materials." If you would like additional photos of the offered artworks, please feel free to contact us—we are happy to assist you.
2.4 By clicking the ‘Buy’ button, the customer enters into a binding agreement to purchase the items in the shopping basket.
2.5 The Seller confirms receipt of the order by email. The contract is only concluded when the order confirmation is sent or the goods are delivered.
3. Prices and payment
3.1 All prices stated in the online shop are final prices in euros. Due to the small business regulation (§ 19 UStG), no sales tax is shown.
3.2 The desired payment method (debit or credit card, PayPal, direct transfer) can be selected in the online shop. For direct transfers, please use the following bank details: GOLDEN SECTION ART, IBAN: DE30 1001 0010 0071 1421 40, BIC: PBNKDEFFXXX, Bank: FYRST. The Seller reserves the right to exclude certain payment methods in individual cases.
4. Shipping and delivery conditions for limited-edition prints
4.1. Delivery will be made to the address provided by the customer, unless otherwise agreed.
4.2. Delivery times and shipping costs are indicated in the online shop under the item ‘Shipping options’. They apply to the delivery, but not to any returns.
4.3 In the event of three unsuccessful delivery attempts, the Seller reserves the right to withdraw from the contract. In this case, the delivery costs will be deducted from the amount paid.
5. Shipping and delivery conditions for unique and framed works
5.1 Delivery of picture sizes over 30 cm x 40 cm is subject to individual agreement. This is due to the increased security requirements involved in the delivery of such products. Both courier delivery and collection are possible. Once you have decided on a suitable product, we will contact you immediately to arrange the delivery formalities with you individually.
5.2. GOLDEN SECTION ART bears the costs of delivery. In the event of a return, the buyer bears the costs.
6. Right of withdrawal (Terms and Conditions) (Cancellation Policy)
6.1 Statutory right of cancellation can be exercised within 14 days and without stating any reason for the cancellation. The customer shall bear the costs of returning the goods if the goods delivered correspond to the goods ordered.
6.2 To exercise the right of cancellation, the customer must send a clear declaration to the Seller by post or by email to [email protected].
6.3 You have the option to contact our customer service directly at (+49) 176 878 904 46 at the following times: Mon, Wed and Thu from 10:00 a.m. to 11:00 a.m. Alternatively, you can send us your phone number by email and we will call you back within 48 hours.
6.4 Please note: According to § 312g para. 2 no. 1 BGB, the right of withdrawal does not apply to contracts for the delivery of goods that are not prefabricated, like personalised works of art, or products that are specifically tailored to the personal needs of the consumer.
6.4 The Seller reserves the right to withhold compensation for any loss in value in accordance with § 357a para. 1 BGB if the delivered artworks are damaged by the customer.
6.5 If you wish to cancel the contract, this must be done in writing.

We also recommend that you always use the original packaging whenever possible to avoid damage when returning goods.
7. Reservation of title
The goods remain the property of the Seller until full payment has been received.
8. Liability and warranty
8.1 The statutory warranty rights apply.
8.2 The seller is only liable for damages caused by intentional or grossly negligent behaviour or based on the violation of an essential contractual obligation.
8.3 Liability for indirect damages, consequential damages and lost profits is excluded, provided this is legally permissible.
9. Copyrights and terms of use
9.1 All artworks offered in the online shop, including graphics, designs and illustrations, are protected by copyright.
9.2 The purchase of a work of art or a reproduction does not grant the buyer any right to duplicate, distribute, make publicly available or edit the work of art in any form.
9.3 Any commercial use, for example through resale, use in advertising material or on websites, is prohibited unless expressly permitted by the copyright holder.
9.4 The buyer is liable for any unauthorised use of the artwork and agrees to accept any claims by third parties arising from the violation of copyright provisions.
9.5 Any use beyond that described requires written permission (licensing) from the Seller or the copyright holder.
9.6 If you are interested in an extended right of use, please feel free to contact us with your request.
10. Dispute resolution and final provisions
10.1 The European Commission provides a platform for online dispute resolution (OS), which can be accessed at https://ec.europa.eu/consumers/odr/main/index.cfm?event=main.home2.show&lng=DE. The Seller does not participate in dispute resolution proceedings before a consumer arbitration board.
10.2 Should individual provisions of these terms and conditions be invalid, the validity of the remaining provisions shall remain unaffected. In place of the invalid provision, the regulation that comes closest to the economic objective of the invalid provision shall apply.
